Pennsylvania Worker and Community Right to Know Act

Purpose:

To give employees access to information about hazardous substances in the workplace.

Policies and Procedures:

  1. The law creates a list of 1,980 chemicals that are defined as hazardous substances. The PA law applies only to those chemicals, or mixtures that contain these chemicals.
  2. The law requires that a list of the hazardous substances used at the workplace be posted in the building where one works.
  3. The law mandates that a material safety data sheet for each substance be readily accessible to individuals.
  4. Containers of hazardous substances or mixtures must be labeled to identify the hazardous ingredients. The label must include the chemical name of the substance, the name and address of the manufacturer, and hazard warning of the substance.
  5. The University must provide an annual training program for employees who may be exposed to any of these 1,980 substances. All new employees must receive training within 120 days of starting work.
  6. The law allows individuals to refuse to work with a hazardous substance if the university fails to provide a material safety data sheet that is in its possession, or fails to furnish proof of a diligent effort to obtain the requested material safety data sheet from a proper source. But the University can reassign individuals to other tasks away from that substance.
